Kidnomics Terms of Service

1. Introduction and Acceptance
These Terms of Service (“Terms”) govern your access to and use of Kidnomics (“we,” “us,” or “our”), including our website at kidnomics.com, our marketplace at shop.kidnomics.com, our mobile applications, and all related services (collectively, the “Platform”).
By creating an account, accessing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Platform.
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Platform. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms.
2. Eligibility
To use the Platform, you must:
Be at least 18 years of age
Be a legal resident of the United States
Have a valid email address
Provide accurate and complete registration information
By registering, you represent and warrant that all information you provide is truthful, accurate, and complete, and that you will maintain the accuracy of such information.
## 3. Account Registration and Security
3.1 Account Creation
You must create an account to access Platform features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Account Security
You agree to:
Notify us immediately of any unauthorized use of your account
Not share your account credentials with any third party
Not create multiple accounts for the same individual
Use a strong, unique password for your account
We are not liable for any loss arising from your failure to maintain the security of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. Upon termination, any accumulated points in your account will be forfeited.

4. The Kidnomics Rewards Program
4.1 Earning Points
Members earn points by submitting qualifying childcare payment receipts through the Platform. Points are earned at a rate determined by Kidnomics and displayed on the Platform (currently 3 points per US dollar spent on qualifying childcare expenses).
Qualifying childcare expenses include payments to licensed daycare centers, preschools, nannies, au pairs, babysitters, and other childcare providers. Kidnomics reserves the right to define and update what constitutes a qualifying expense.
4.2 Receipt Submission and Verification
When you submit a receipt, you represent and warrant that:
The receipt is genuine and unaltered
The payment was made by you or on your behalf
The receipt has not been previously submitted to Kidnomics
The childcare services were actually rendered
Kidnomics reviews submitted receipts and reserves the right to approve, reject, or flag receipts for manual review. Receipts exceeding certain thresholds may be held for additional verification.
Submitting fraudulent, altered, or duplicate receipts is a violation of these Terms and may result in immediate account termination and forfeiture of all points.
4.3 Points Caps and Limits
The following limits apply to point earning (subject to change):
Maximum receipts per calendar month: 5
Maximum qualifying childcare spend per calendar month: $10,000
Receipts exceeding $8,000 per submission are subject to manual review
Receipts must be dated within the last 365 days
Duplicate receipts (same provider, date, and amount) submitted within 90 days will be rejected
4.4 Point Value and Redemption
Points have no cash value and cannot be transferred, sold, or exchanged for cash. Points may only be redeemed through the Kidnomics Marketplace at shop.kidnomics.com.
When redeeming points, the maximum number of points applicable to any single product variant is determined by the discount pool set for that product. The discount pool may be calculated as a fixed dollar amount or as a percentage of the product variant’s listed price, at Kidnomics’s discretion. The discount generated by point redemption is applied via a one-time discount code at checkout.
Points do not expire as long as your account remains active and in good standing. Kidnomics reserves the right to implement point expiration policies with at least 90 days’ prior written notice.
4.5 Points Adjustments
Kidnomics reserves the right to adjust point balances in the following circumstances:
Correction of errors in point calculation or award
Reversal of points earned through fraudulent or invalid receipts
System errors or technical malfunctions
Changes to the earning rate (applied prospectively only)
4.6 Program Changes
Kidnomics reserves the right to modify, suspend, or discontinue any aspect of the Rewards Program, including earning rates, redemption values, caps, and limits, at any time with reasonable notice to members.
4.7 Childcare Provider Partnerships
Kidnomics may partner with childcare providers, daycare centers, and preschools to offer the Program to their families. If you sign up through a childcare provider partnership (for example, via a referral link or QR code provided by your childcare provider), Kidnomics may track which provider referred you for program administration purposes.
Your childcare provider will not have access to your account information, points balance, purchase history, or any other personal data. Kidnomics may share aggregated, anonymized data with partner childcare providers, such as the number of families enrolled through their program, but will never share individually identifiable information without your explicit consent.
5. Referral Program
5.1 How Referrals Work
Members may refer friends and family to Kidnomics using a unique referral link or QR code. When a referred individual creates an account using a valid referral link:
The referring member (“Referrer”) receives 500 bonus points
The new member (“Referred”) receives 500 bonus points
When the Referred member uploads their first qualifying childcare receipt, the Referrer receives an additional 1,000 bonus points.
5.2 Referral Program Rules
Referral bonuses are awarded once per unique referral relationship
Self-referrals are not permitted
Referral abuse, including creating fake accounts or using automated systems, will result in forfeiture of referral points and potential account termination
Kidnomics reserves the right to modify or discontinue the referral program at any time
6. The Kidnomics Marketplace
6.1 Marketplace Overview
The Kidnomics Marketplace at shop.kidnomics.com is operated by Kidnomics and features products from third-party vendor partners (“Vendors”). Kidnomics acts as a marketplace facilitator, not the seller of products. Vendors sell directly to customers and fulfill orders themselves. Kidnomics does not take possession of, warehouse, or ship any products sold through the Marketplace.
6.2 Product Listings
Product descriptions, images, pricing, and availability are provided by Vendors and may change without notice. While we strive for accuracy, Kidnomics does not guarantee that product listings are complete, current, or error-free.
6.3 Pricing
Products on the Marketplace are listed at prices set by Vendors. Prices are displayed in US dollars and are subject to applicable sales tax. Prices may change at any time without prior notice.
When Vendors offer promotional pricing, members may be able to apply points-based discounts in addition to the promotional price. The availability and extent of points-based discounts during Vendor promotions is determined by Kidnomics at its sole discretion.
Kidnomics operates as a marketplace facilitator. Applicable sales taxes are collected at checkout in accordance with state and local requirements.
6.4 Points Redemption at Checkout
Members who are logged in may apply their points balance toward qualifying purchases using the “Unlock with Points” feature. The maximum discount per product variant is capped at the discount pool value set for that product, which may vary by product variant based on the variant’s price.
The points-applied discount is available only to logged-in Kidnomics members and is not publicly advertised. The discount is applied via a one-time discount code generated at the time of redemption. Discount codes are:
Valid for single use only
Non-transferable
Subject to expiration as noted at time of generation
Not combinable with non-Kidnomics discount codes. Multiple Kidnomics-generated discount codes may be applied to a single order if the Platform supports multi-item redemption.
6.5 Orders and Fulfillment
Orders placed through the Marketplace are fulfilled directly by the Vendor, not by Kidnomics. Shipping times, methods, and costs are determined by the Vendor. Kidnomics is not responsible for delays, damage, or errors in fulfillment by Vendors.
6.6 Returns and Refunds
Return policies are determined by individual Vendors and may vary. If you wish to return a product purchased through the Marketplace:
Contact Kidnomics at hello@kidnomics.com within 30 days of receipt
We will coordinate with the Vendor on your behalf
Refunds will be processed according to the Vendor’s return policy
For defective or incorrect products, the Vendor is responsible for return shipping costs
For change-of-mind returns, the customer is responsible for return shipping costs
Points used in a transaction that is refunded will be restored to your account within 5 business days of the refund being processed
Kidnomics is not responsible for Vendor return policies and cannot guarantee that all products are returnable.
6.7 Product Liability
Products available on the Marketplace are manufactured, packaged, and shipped by Vendors. Kidnomics does not manufacture, inspect, or test any products sold through the Marketplace. Vendors are solely responsible for product safety, quality, labeling, and compliance with applicable laws and regulations.
To the fullest extent permitted by law, Kidnomics disclaims all liability for injuries, damages, or losses arising from the use of products purchased through the Marketplace.
7. Prohibited Conduct
You agree not to:
Submit fraudulent, forged, or altered receipts
Create multiple accounts or refer yourself
Use automated systems, bots, or scripts to interact with the Platform
Attempt to manipulate point balances, exploit system errors, or circumvent caps and limits
Interfere with the Platform’s security, integrity, or availability
Use the Platform for any illegal purpose
Impersonate another person or entity
Reverse engineer, decompile, or disassemble any part of the Platform
Scrape, harvest, or collect data from the Platform without authorization
8. Intellectual Property
8.1 Kidnomics Property
The Platform, including its design, features, content, software, and trademarks, is the property of Kidnomics and is protected by intellectual property laws. You may not use, reproduce, or distribute any Kidnomics intellectual property without prior written consent.
8.2 User Content
By submitting receipts, feedback, or other content to the Platform, you grant Kidnomics a non-exclusive, royalty-free, worldwide license to use, store, and process such content for the purpose of operating and improving the Platform.
9. Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
KIDNOMICS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIDNOMICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.
IN NO EVENT SHALL KIDNOMICS’ TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO KIDNOMICS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
11. Indemnification
You agree to indemnify, defend, and hold harmless Kidnomics, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from:
Your use of the Platform
Your violation of these Terms
Your violation of any third-party rights
Any content you submit to the Platform
12. Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
12.2 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us at hello@kidnomics.com and attempt to resolve the dispute informally for at least 30 days.
12.3 Arbitration
Any dispute not resolved informally shall be resolved by binding arbitration administered by JAMS in San Francisco, California. The arbitration shall be conducted by a single arbitrator in accordance with JAMS’ Streamlined Arbitration Rules. The arbitrator’s decision shall be final and binding.
12.4 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
13. General Provisions
13.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kidnomics regarding the Platform.
13.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
13.3 Waiver
The failure of Kidnomics to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
13.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. Kidnomics may assign these Terms at any time without notice.
14. Errors, Inaccuracies and Omissions
Occasionally there may be information on or in the Platform that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, points calculations, or availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
15. Optional Tools
You may be provided with access to customer tools offered by third parties as part of the Platform, including the points slider widget, analytics tools, and other features, which we may neither monitor nor have full control over.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the Platform is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new features through the Platform (including the release of new tools and resources). Such new features shall also be deemed part of the Platform and are subject to these Terms.
16. Third-Party Links
The Platform may contain materials and hyperlinks to websites provided or operated by third parties, including Vendor websites and partner childcare provider sites (including any embedded third-party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Platform to access these materials or third-party sites, you do so at your own risk.
We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.
17. Feedback
If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use. We may, for example, use our rights under this license to operate, provide, evaluate, enhance, improve and promote the Platform and to perform our obligations and exercise our rights under these Terms.
You also represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback will comply with these Terms. We are and shall be under no obligation (1) to maintain your Feedback in confidence; (2) to pay compensation for your Feedback; or (3) to respond to your Feedback.
We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms.
You agree that your Feedback will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your Feedback will not contain libelous or otherwise unlawful, abusive or obscene content, or contain any computer virus or other malware that could in any way affect the operation of the Platform or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Feedback. You are solely responsible for any Feedback you make and its accuracy.
18. Relationship with Shopify
Kidnomics is powered by Shopify, which enables us to provide the Marketplace at shop.kidnomics.com. However, any sales and purchases you make in our Marketplace are made directly with Kidnomics and the applicable Vendors, not with Shopify. By using the Platform, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Kidnomics, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Kidnomics.
19. Agents and Automated Access
19.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any part of the Platform. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.
19.2 No Agent may access, use, or interact with the Platform unless, at all times, it identifies itself and operates in strict accordance with the requirements in Section 19.4 below. In addition, no Agent may access, use, or interact with the Platform if we have requested that the Agent refrain from accessing, using, or interacting with the Platform.
19.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with the Platform.
19.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans; (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer; (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Platform.
19.5 Submitting receipts, redeeming points, or otherwise interacting with the Kidnomics Rewards Program via an Agent without express prior written authorization from Kidnomics is prohibited and may result in immediate account termination and forfeiture of all points.
